Big Trees Village Property Owners Association Newsletter

Summer 2006 Edition

 

This edition of the Big Trees Village Property Owners Association newsletter is being mailed to all property owners in Big Trees Village. It includes information about the history of Big Trees Village and the Property Owners Association. The Board of Directors hopes you enjoy the newsletter and invites you to contact the Property Owners Association with any questions you might have about our community.

History

Here's a brief history of the development of Big Trees Village. In the late 1960s, American Forest Properties, a timber company, developed Big Trees Village. It sold lots with CC&Rs that describe and regulate the appearance of our community. To enhance the value of the subdivision, American Forest Products also developed and built the Recreation Center including the swimming pools, tennis courts, and picnic area and recreation field located on a seventeen acre parcel. The new Recreation Center and the surrounding seventeen acres were offered to the property owners in Big Trees Village (at no cost), provided they voted by a 2/3rds majority to accept it. The vote was successful, and title to the Recreation Center was transferred from the development company to the Big Trees Village Property Owners Association as a mutual benefit, non-profit California corporation in 1972. The By-Laws of our Big Trees Village Property Owners Association is our governing document. It states that the purpose of the Association is to enforce the CC&Rs for the properties in Big Trees Village and to manage the Recreation Center.

CC&Rs

Many planned development subdivisions like Big Trees Village come with covenants, conditions, and restrictions (CC&Rs). Developers, like American Forest Products, introduce the CC&Rs as a means of enhancing the value of the community. This is deemed especially important in developments where a natural view or ambience is the reason for buyers to purchase. The vast majority of homeowners in BTV buy here for the forest and mountain scenery and for the quick access to skiing, fishing and hiking.

CC&Rs have played a cornerstone role in the appearance of our Big Trees Village community throughout its development and as it exists today. The "rules" in our CC&Rs are minimal compared to many other similar associations: houses need to be at least 800 square feet, businesses that are conducted from home cannot occupy more than 25% of the square footage and business signs are not permitted, homes are to be earth colors, mobile and pre-fabricated homes are not permitted, RVs and boats may not be parked in driveways, fences are not allowed, and plans for additions and new construction need to be submitted to the design committee for approval. The year round professional Manager fields hundreds of questions every year from property owners and contractors about the design standards and CC&Rs. He also answers thousands of "nuts and bolts" questions from Big Trees Village property owners about owning and maintaining property in Calaveras County. He keeps his eye on the subdivision and drives our streets regularly.

Big Trees Village is Unique!

Ours is a unique Association. While adherence to the CC&Rs is mandatory, membership in the Association in any given year is voluntary. There are two levels of Membership. The first is called Associate membership. The dues for this level of membership ($75 per year) are used to maintain the value and enjoyment of our properties in Big Trees Village. The Manager is available to you year round to answer a wide range of questions you may have about your property in Big Trees. The Manager and Board also oversee administration of the CC&Rs. Dues for Associate membership are not used to fund or manage the Recreation Center; rather, Associate Member dues go only for the maintenance and enhancement of the Big Trees Village community.

The other level of membership is Recreation Center membership. This level includes the Associate Membership fee ($75) mentioned in the previous paragraph to support the larger community of Big Trees Village. The additional cost of this level of membership goes to fund the Recreation Center, which includes hiring the summer staff, paying for the insurance, conducting the summer activities, maintaining the buildings and equipment, and purchasing propane to heat the pools.

Future of Big Trees Village when CC&Rs Expire:
Currently, the Board of Directors of the Property Owners Association manages the Recreation Center and enforces the CC&Rs for the Big Trees Village. The Recreation Center and surrounding seventeen acres is owned by the Associate and Recreation Center Members. Starting in 2016 with Unit 1, our CC&Rs will begin to expire. Over the few years following that, the CC&Rs for all the other Units will also expire leaving Big Trees Village as the only major subdivision on Highway 4/Ebberts Pass corridor without CC&Rs. After expiration, we will become simply homes and lots located in unincorporated Calaveras County regulated by the County and State codes. We will have businesses with business signs, fences, and mobile homes. (The Board currently declines several requests per year for mobile homes.) Association Members will no longer own the Recreation Center. It will be disposed of and may become either a private club, another development or both.

What's Next?

The Big Trees Village Property Owners Association Board of Directors wants all property owners to receive information about the activities in Big Trees Village so we can preserve and increase the value of our wonderful community.
