Big Trees Village Future

 

The Big Trees Village Property Owners Association legal documents, with their Covenants, Codes, and Restrictions (CC&Rs), begin to expire in 2016. This may well affect property values and result in the loss of the Recreation Center. It is prudent to begin a discussion about what direction the Association will take once the current documents expire.

Our Association is unusual among “common space” associations in California. This is true because most others define a mechanism in their By-Laws to continue their Associations when their current By-Laws expire. There are no provisions in our legal documents to extend our community once the documents expire. Our community is made up of eleven units. Each has its own CC&Rs. While they are similar, they are not identical. The CC&Rs for Unit 1 expire in 2016 and the remaining ten units’ CC&Rs expire in the next several years after that.

Once they expire, the building design standards that have provided a framework for the appearance of our community as it exists today will no longer be in force. We can expect to see fences, mobile homes, and businesses with street signage.

Also, the Recreation Center, and its surrounding seventeen acres of common space, is owned by the Property Owners Association. Once the CC&Rs expire, ownership of that common space and Recreation Center would be uncertain.

It was therefore recommended at the Annual Property Owners’ Members meeting held in May2004, that this website be used as one of the tools available to us to begin a discussion about our future and what options we might have as our CC&Rs begin to expire. The Board also believes that in order to plan for the future of Big Trees Village once the CC&Rs expire, it is important to communicate with all property owners, not just those who are current members of the Association. Therefore the Board decided to send its newsletter, newly renamed the Big Trees Village Voice, on a regular basis to all property owners in Big Trees Village. The first newsletter was distributed in September, 2006.
